WiseGuy is committed to protecting user privacy, ensuring responsible data handling, maintaining cybersecurity standards, operating transparently, respecting consumer rights, and complying with applicable South African laws and regulations.

We continuously review our systems, policies, and operational procedures to improve compliance and platform integrity.

Our operations are designed with consideration for the following applicable laws:

• Protection of Personal Information Act 4 of 2013 ("POPIA"), governing the collection and processing of personal information
• Consumer Protection Act 68 of 2008 ("CPA"), protecting consumer rights and fair commercial practices
• Electronic Communications and Transactions Act 25 of 2002 ("ECTA"), governing electronic agents, transactions, and contracts
• Copyright Act 98 of 1978, protecting intellectual property rights
• Cybercrimes Act 19 of 2020, governing cybercrime and platform security obligations
• Advertising and electronic marketing regulations, including direct marketing provisions under POPIA

WiseGuy processes personal information in accordance with POPIA principles including accountability, lawful processing, purpose limitation, data minimisation, transparency, security safeguards, and data subject participation.

We collect only information reasonably necessary to provide the service. We do not sell your personal information to third parties. We provide mechanisms for users to exercise their rights including access, correction, deletion, objection, and consent withdrawal.

WiseGuy operates as a price comparison and data aggregation platform. Our systems collect publicly available commercial information from external retailer websites for search functionality, price comparison, market transparency, analytics, and platform indexing.

We aim to:

• Avoid collecting unlawfully exposed personal information from third-party sources
• Avoid bypassing authentication systems, CAPTCHAs, or security measures
• Avoid collecting passwords, private account data, or confidential credentials
• Avoid intentional disruption of third-party systems through excessive requests
• Respect applicable intellectual property rights, we display product information with attribution and links to original sources
• Honour robots.txt directives where reasonably applicable
• Operate responsibly and ethically when interacting with publicly accessible data

Third-party websites remain responsible for their own pricing, product listings, availability, and content accuracy. WiseGuy does not guarantee the accuracy of information sourced from third parties.

WiseGuy is an informational and comparison platform, not a retailer. We aim to provide clear and transparent information to users:

• Prices displayed are sourced from third-party retailers and may change without notice
• Product availability may vary from what is displayed
• Third-party retailers control final pricing and fulfilment
• Promotions and specials may expire
• AI-generated search summaries and deal ratings are indicative and informational only

WiseGuy does not guarantee uninterrupted availability, real-time price accuracy, or identical pricing across all platforms at all times. Always verify pricing on the retailer's website before purchase.

WiseGuy uses AI-powered search technology including large language models (LLMs) to process user search queries, generate price comparison summaries, provide no-results guidance, and deliver deal analysis. Users acknowledge that:

• Search queries are processed by AI/LLM systems to generate results
• AI-generated content is indicative and informational, not a guarantee of pricing, availability, or savings
• Automated recommendation and ranking systems analyse aggregated pricing trends and search behaviour to improve results
• We do not make legally binding decisions solely through automated processing without human oversight where required

Premium subscriptions are processed via Stripe, a globally recognised payment processor operating in compliance with PCI DSS standards. WiseGuy does not store full payment card details. Subscription terms, pricing, and cancellation rights are disclosed at the point of subscription and in our Terms and Conditions. Users may cancel at any time through their account settings.

WiseGuy provides an advertising platform for South African businesses. Advertisers are required to:

• Submit accurate, truthful product and pricing information
• Comply with the Consumer Protection Act and applicable advertising standards
• Not make false, misleading, or deceptive claims in listings or ads

Sponsored content and promoted listings are identified where applicable. Advertising relationships do not determine organic search ranking.

WiseGuy operates an affiliate and referral programme. Affiliate relationships are disclosed in our Terms and Conditions and where applicable on the Platform. Commissions are earned only on valid referrals in accordance with programme terms. Affiliate relationships do not influence the objectivity of product comparison results unless explicitly disclosed as sponsored.

WiseGuy uses cookies and similar technologies in compliance with POPIA. Our platform blocks non-essential cookies until explicit user consent is provided. Users may manage, update, or withdraw cookie consent at any time via the Cookie Policy page. Cookie categories and purposes are clearly disclosed.

We implement reasonable technical and organisational safeguards to protect our systems and users including encrypted communications (HTTPS), access controls, authentication systems, monitoring systems, vulnerability management, and periodic security reviews. Despite reasonable safeguards, no digital platform can guarantee absolute security. Users should use strong passwords and report suspicious activity immediately.

By using WiseGuy, users agree not to misuse the platform, attempt unauthorised access, disrupt services, exploit vulnerabilities, use automated abuse systems, submit false information, or violate applicable laws. Users are responsible for maintaining account confidentiality and ensuring lawful use of the platform.

We retain personal information only for legitimate operational purposes, legal obligations, security monitoring, dispute resolution, and regulatory compliance. Information may be anonymized, de-identified, archived, or securely deleted when no longer required.

WiseGuy maintains procedures for identifying security incidents, responding to breaches, mitigating risks, and complying with notification obligations. Where legally required, affected users and regulators will be notified of qualifying incidents in accordance with POPIA requirements.

We may update this Compliance Statement periodically to reflect regulatory changes, operational changes, technological developments, and evolving compliance standards. Updated versions become effective upon publication. Continued use of the platform constitutes acceptance of updated terms and policies.
